Concessions Council
The task of the Concessions Council, operating within the framework of the Supervisory Authority for Regulatory Affairs, is to develop unified state-level jurisprudence regarding concessions.
SARA contributes to the enforcement of the principles of the Concessions Act and the sectoral laws that define the methods and detailed conditions for carrying out economic activities that fall within the exclusive competence of the State.
In order to facilitate the application of the legislation on concessions, the Concessions Council issues guidelines, communications and information materials. It provides guidance based on appeal decisions and the experience gained from the control of concession activities, and also offers practical information on concessions.
As part of its judicial development activities and with regard to concession regulations, the Council makes proposals to the entitled body to issue, amend or repeal a legislation.
The Council evaluates the practice of concession contracts over recent decades and assesses their impact on the national economy. In order to evaluate concession contracts, it has been necessary to define a set of criteria, and continuously develop them based on national and international experience. These criteria serve as guidelines while exercising SARA’s statutory right of prior approval for ongoing and future concession contracts.
The Concessions Council consists of six members: the President of SARA, the General Vice President of SARA, a member delegated by the Prime Minister of Hungary, a member delegated by the President of the Hungarian Competition Authority, a member delegated by the President of the Public Procurement Authority, and a member delegated by the President of SARA.
