Supervision of Court Bailiffs and Liquidators

SARA supervises professional procedures related to court enforcement, bankruptcy and liquidation proceedings, and performs statutory tasks related to the activities of restructuring experts.

Supervision of Liquidators

With regard to the supervision of liquidation organizations, the Authority monitors their compliance with the legislation applicable to them.

SARA keeps the official register of liquidation organizations admitted by tender, the official register of those who have not been included in the register of liquidators due to the limited framework number, and the register of public liquidators. The Authority issues the certificate of authority for liquidating organizations, it operates the Electronic Sales System, the Electronic Designation System, and the Liquidation Register System.

Supervision of Court Bailiffs

Enforcement in Hungary is implemented by independent court bailiffs. As a non-litigious civil procedure, the court bailiffs’ procedure is identical to that of the court.

SARA exercises general supervision over the system of enforcement organizations, and exercises legal supervision over their professional and advocacy body, the Hungarian Association of Court Bailiffs. Legal supervision includes the examination of the organizational and operational regulations of the Association, the Code of Ethics, the Association’s guidelines and the decisions of the Association’s bodies. SARA participates in the examination of applications for employment, and the President of the Authority exercises the power to appoint and dismiss court bailiffs.

It is a major step forward in both areas that the authority responsible for monitoring the legality of their activities has been set up specifically to carry out supervisory tasks. The organisational form of the Authority ensures that the supervision of these professions is based on the strictest standards, and that liquidators and court bailiffs carry out their tasks in a professional, lawful and empathic manner, so that they enjoy a high level of public confidence in the long term.
